Usage of Opizo

The Opizo Platform (including any mobile-based applications, website, and web applications) is provided by Unibit Pvt. Ltd. ("Unibit"). Through the Opizo Platform, any person ("User") with a verified account can access and participate in the services provided via the Opizo Platform.

A User accessing the Opizo Platform shall be bound by these Terms & Conditions, and all other rules, regulations, and terms of use referred to herein or provided by Unibit about any services provided via the Opizo Platform ("Opizo Services").

Unibit shall be entitled to modify these Terms & Conditions, rules, and regulations at any time by posting them on the Opizo Platform. Use of Opizo constitutes the User’s acceptance of such Terms & Conditions, rules, and regulations, as may be amended from time to time. Unibit may, at its sole discretion, also notify the User of any changes by sending an email to the User’s registered email address or posting notifications in the User accounts. If the User does not exercise any provided option to indicate non-acceptance within the prescribed timeframe, the User will be deemed to have accepted the modified Terms & Conditions.

Certain Opizo Services may be subject to additional rules and regulations. In case of inconsistency, the additional conditions shall prevail.

Unibit may, at its sole and absolute discretion:

• Restrict, suspend, or terminate any User’s access to all or any part of Opizo Services.
• Change, suspend, or discontinue all or any part of Opizo Services.
• Reject, move, or remove any material submitted by a User.
• Move or remove any content available on the Opizo Platform.
• Deactivate or delete a User’s account and all related information and files.
• Establish general practices and limits concerning the use of the Opizo Platform.
• Offer discounts or cash rewards in a form it deems fit ("Cash Bonus").
• Revise or make additions and/or deletions to data or information provided about services.
• Assign its rights and liabilities to all User accounts hereunder to any entity (post such assignment, intimation of the assignment shall be sent to all Users via registered email IDs).

If any User breaches these Terms & Conditions, or Unibit reasonably believes that such User has engaged in illegal or improper use of Opizo, Unibit may, without notice, restrict, suspend, or terminate the User’s access, delete the User’s account, remove any content posted by the User, and take legal steps as necessary.

If Unibit charges a platform fee for any Opizo Services, such fees will be refunded in case of suspension or removal of the User’s account due to negligence or deficiency on Unibit’s part. However, no refund will be made if the suspension or removal is due to:

• Any breach or inadequate performance by the User of these Terms & Conditions.
• Any circumstances beyond Unibit's reasonable control.

By accepting these Terms & Conditions, Users consent to receive communications such as announcements, administrative messages, and advertisements from Unibit or its partners, licensors, or associates.

By accepting the Terms and Conditions of our platform, you expressly consent to our collection and use of your personal data, specifically your phone number, for the purpose of contacting you through phone calls, IVR and RCS messaging. These calls and messages may be made to remind you of any relevant updates, activities, or information regarding your account, as well as to inform you about new offers, promotions, or updates related to our platform and services. You acknowledge and agree that we may use your phone number to provide these communications and understand that this is a necessary part of your engagement with our platform. You may opt out of receiving such communications at any time by contacting our support team or following the opt-out instructions provided in any communication. However, opting out of promotional calls will not affect non-promotional or service-related communications that are essential to your use of the platform.

Any User who is “incompetent to contract” within the meaning of the Indian Contract Act, 1872 (including minors, un-discharged insolvents, etc.) is not eligible to enter into this Agreement with Unibit. For Opizo Services, an “Agreement” shall mean these Terms & Conditions, the Privacy Policy, and any other applicable rules or policies, including additional or modified terms about the Opizo Platform. This Agreement is published following Rule 3(1) of the Information Technology (Intermediary Guidelines) Rules, 2011 and is an electronic record generated by a computer system that does not require physical or digital signatures.

Certain services provided by Opizo may be subject to additional conditions or rules ("Service Terms"). Such Service Terms are deemed to be incorporated herein by reference. Users must agree to these Service Terms before using such specific services. In case of inconsistency, the Service Terms shall prevail.

Opizo Services

Opizo Platform:

Through the Opizo Platform, a User, exercising knowledge about a given subject and based on publicly available information (including such information collated and made available through the Opizo Platform) can engage with various interactive features and services provided.

Opizo Fantasy Sports:

Opizo Fantasy Sports is designed to provide Users with an immersive fantasy game format. Through Opizo Fantasy Sports, a User can participate in various online fantasy competitions based on real-world sports.

Rules and Principles Applicable for Opizo Fantasy Sports:

Opizo provides fantasy sports to the Users on the Platform. Opizo Fantasy Sports is a brand owned and operated by Unibit. It is an online-based fantasy sport that allows its Users to create their teams composed of real players participating in real sporting events. Users play Opizo Fantasy Sports by using their knowledge and skill of the respective sport.

Rules for Opizo Fantasy Sports:

Opizo Fantasy Sports is an online fantasy sports contest where Users pay an entry fee to participate, allowing them to build and manage teams consisting of real players or teams. These fantasy teams compete against those of other Users, with results determined based on real-life player statistics in professional matches. Users can enter Contests, which are skill-based competitions available on the Opizo Platform. Contests may be either ‘paid’ or ‘free to play.’ Paid Contests require Users to pay a participation fee, whereas free-to-play Contests are open to all Users without monetary payment unless otherwise specified. Users can participate in upcoming Contests linked to real-world matches.

All Users while creating a fantasy sports team (“Fantasy Team”) for any match are provided with the same budget. Any budget adjustments shall be uniformly applied to all players. Users must select their teams based on pre-defined composition rules, including limits on the number of players per category (e.g., batsmen, bowlers, all-rounders, goalkeepers, etc.).

Users can modify their Fantasy Teams until the registration deadline for the Contest. A maximum number of players from one real-life team can be included in a single Fantasy Team.

Depending on match circumstances, Users may edit their Fantasy Teams until the official match start time, as declared by the event's official organizer or an adjusted deadline.

Opizo Fantasy Sports reserves the right to abandon a Contest or adjust deadlines in certain unforeseen scenarios, including but not limited to delays in match commencement due to weather conditions, technical interruptions, or non-appearance of teams.

Fantasy Teams are awarded points based on real-life player performances at the end of a designated match or tournament. Participants with the highest aggregate scores in a Contest are declared winners. In some Contests, multiple winners may be declared, with prizes distributed based on team rankings.

Users will not have access to auto-complete or auto-fill features for their teams and/or responses within the Contest.

Player rankings and credits fluctuate dynamically during contests based on real-life performance. Fantasy Teams continuously earn points based on the performance of selected players, with updates reflected in real-time.

Opizo ensures that all Contests offered to Users maintain competitive integrity and incorporate fair-play principles. Unibit is committed to upholding fairness and competitiveness within Opizo Fantasy Sports.

Payment:

Payments shall be made using Opizo’s wallet system and KYC-verified payment processes. Payment terms applicable to the Opizo Platform shall also apply to Opizo Fantasy Sports.

Participation in the Opizo Platform

As part of its services, Opizo shall, via the Opizo Platform, make available questions relating to the probability of the occurrence of a specified future event, data and information collated from publicly available sources related to the specified future event, and/or the ability for Users to add their own opinions, data/information related to a particular future event.

Depending upon the potential outcome for each specified future event, the time period of occurrence of such specified future event, the number of bids received for a specified future event, and any other factors that might be relevant in Opizo’s sole discretion, Users may be allowed to edit their bids and/or place multiple bids on the occurrence of a specified future event.

The Opizo Platform shall, on a best-efforts basis, attempt to match a User’s bid on a specified future event with a complementary bid of another User. Once a complementary bid is found and a match is made, neither of the two Users shall be allowed to withdraw their specific bid, and the settlement of the bids between the two Users shall be determined based on the occurrence and outcome of the specified future event on which the two Users have placed their bids. If a User makes a bid on a specified future event but no complementary bid is available till the occurrence of the specified future event, the bid amount will be returned to the User.

Opizo reserves the right to abandon a specific question or set of questions related to a specified future event or adjust the deadline for bidding on such specified future event in certain specific, uncertain scenarios, that are beyond Opizo’s reasonable control. Opizo shall endeavour to send communications through various modes including but not limited to emails and/or SMS communication and/or WhatsApp messages, about any such change to keep the User updated.

Bidding on certain specified future events might have specific rules that Opizo will notify the User(s) before making the bid. Such rules will be in addition to these Terms and Conditions unless otherwise specified in the said rules.

To place a bid, a User must pay a certain amount that is equivalent/commensurate with the likelihood of occurrence of a specified future event. A winning bid is determined based on the occurrence and outcome of a specified future event. A User’s bid on the said event will be deemed to be successful if the parameters which formed the basis for the User making a bid are met and/or have occurred. If the parameters that formed the basis for the User making a bid are not met and/or have not occurred, the bid shall not be successful.

All Users understand and acknowledge that participation via the Opizo Platform and placing bids on specified future events by a User is based on the User’s individual analysis of the possibility of occurrence of a specified future event. While Opizo collates and provides data and information related to future events from publicly available sources on the Opizo Platform, Users are encouraged to use their own methods to collect/gather/collate and analyze information related to the specified future event and bid on the said event only after making a thorough and detailed analysis and determination as to the possibility of success of their individual bids.

To bid on a specified future event, a User must add money to their account on the Opizo Platform (“Opizo Account”). Opizo may, in its sole discretion, specify the amounts that can be added and/or held by a User either in aggregate or in tranches. Credits and debits towards making bids, winning bids, or losing bids will be made to and from (as the case may be) the User’s Opizo Account.

Participation in Opizo Contests

Each User who joins a Contest shall pay an entry fee ("Entry Fee") which is decided by Opizo for each Contest. The Entry Fee may differ for each Contest. "Entry Fee" for the purpose of participation in Opizo contests refers to the amount that Users pay in the form of cash balance available in the User’s Opizo Account to participate in a Contest on the Platform as their respective contribution to the Final Prize Money for the Contest.

"Final Prize Money" refers to the actual or projected amount that will be distributed amongst the winner(s) of the Contest and is declared at the start of the Contest.

If a Contest allows a User to register multiple teams, then each team registered by the User is counted as a slot filled in the Contest. The User is required to pay the Entry Fees for each participation in the Contest.

Pooled Contests or Non-Guaranteed Contests:

• Pooled Contests are Contests where the Final Prize Money on offer increases with the number of slots filled in the tournament. However, the Entry Fee on each team registration remains constant for any number of slots filled.
• Non-Guaranteed Contests are Contests that get cancelled and all Entry Fees paid shall be refunded to the respective User if the minimum number of Users required did not join the tournament.

Intellectual Property

Opizo includes a combination of content collected/collated/analyzed by Opizo, its partners, affiliates, licensors, associates, and/or Users. The intellectual property rights ("Intellectual Property Rights") in all software underlying Opizo and the Opizo Platform and material published on the Opizo Platform, including (but not limited to) software, advertisements, content (whether written, audio, and/or visual), photographs, graphics, images, illustrations, graphs, charts, marks, logos, audio or video clippings, animations, etc., is owned by Opizo, its partners, licensors, and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on Opizo either in whole or in part without an express written license from Opizo.

Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available via the Opizo Platform ("Users’ Content"). Each User represents and warrants that they own all Intellectual Property Rights in the User’s Content and that no part of the User’s Content infringes any third-party rights. Users further confirm and undertake not to display or use the names, logos, marks, labels, trademarks, copyrights, or intellectual and proprietary rights of any third party on the Opizo Platform. Users agree to indemnify and hold harmless Opizo, its directors, employees, affiliates, and assigns against all costs, damages, loss, and harm, including litigation costs and counsel fees, in respect of any third-party claims that may be initiated, including for infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights, or intellectual and proprietary rights on the Opizo Platform by such User or through the User’s commissions or omissions.

Users hereby grant to Opizo and its affiliates, partners, licensors, and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users’ Content for any of the following purposes:

• Displaying Users’ Content on Opizo
• Distributing Users’ Content, either electronically or via other media, to other Users seeking to download or otherwise acquire it
• Storing Users’ Content in a remote database accessible by end users, for a charge

This license shall apply to the distribution and storage of Users’ Content in any form, medium, or technology.

All names, logos, marks, labels, trademarks, copyrights, or intellectual and proprietary rights on the Opizo Platform belonging to any person (including a User), entity, or third party are recognized as proprietary to the respective owners. Any claims, controversy, or issues against these names, logos, marks, labels, trademarks, copyrights, or intellectual and proprietary rights must be directly addressed to the respective parties under notice to Opizo.


Third-Party Sites, Services and Products

Links to other Internet sites owned and operated by third parties may be provided via the Opizo Platform. Users’ use of each of those sites is subject to the conditions, if any, posted by the sites. Opizo does not exercise control over any Internet sites apart from the Opizo Platform and cannot be held responsible for any content residing in any third-party Internet site. Opizo's inclusion of third-party content or links to third-party Internet sites is not an endorsement by Opizo of such third-party Internet sites.

User’s correspondence, transactions/offers, or related activities with third parties, including payment providers and verification service providers, are solely between the User and that third party. User’s correspondence, transactions, and usage of the services/offers of such third parties shall be subject to the terms and conditions, policies, and other service terms adopted/implemented by such third parties, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third parties. The User agrees that Opizo will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third-party product or service should be directed to the appropriate vendor.

The Opizo Platform contains content that is created by Opizo as well as content provided by third parties. Opizo does not guarantee the accuracy, integrity, or quality of the content provided by third parties, and such content may not be relied upon by the Users in utilizing the Opizo Services provided on the Opizo Platform.

Privacy PolicyAll information collected from Users, such as registration and credit card information, is subject to Opizo's Privacy Policy, which is available at the Privacy Policy.


User Conduct

Users agree to abide by these Terms & Conditions and all other rules, regulations, and terms of use of the Opizo Platform. In the event a User does not comply, Unibit may, at its sole discretion, take necessary remedial action, including but not limited to:

• Restricting, suspending, or terminating any User’s access to all or any part of Opizo Services.
• Deactivating or deleting a User’s account and all related information and files. Any unused amount in the User’s Opizo account at the time of deactivation shall be transferred to the User’s bank account, subject to applicable processing fees.

Users agree to provide true, accurate, current, and complete information at the time of registration and update their details as required. A User shall not register or operate more than one account with Opizo.

Each User specifically consents to receiving communications from Opizo via email, SMS, and WhatsApp messages. Users are responsible for ensuring they receive communications and acknowledge that Unibit is not liable if such messages go unread due to delivery to junk or spam folders.

Users agree to exit/log out of their accounts at the end of each session. Opizo is not responsible for any loss or damage arising from failure to do so.

Users agree not to use cheats, exploits, automation, bots, hacks, or unauthorized third-party software that interferes with Opizo Services. Users shall not copy, modify, rent, lease, loan, sell, assign, distribute, reverse-engineer, or otherwise transfer rights to Opizo technology or software.

Users shall not disrupt, overburden, or assist in disrupting or overburdening Opizo’s servers or services. Users must not attempt unauthorized access to Opizo accounts, servers, or networks, nor publish misleading, defamatory, obscene, or otherwise unlawful content.

Without limiting the foregoing, Users agree not to:

• Engage in obscene, offensive, indecent, racial, communal, or defamatory communication.
• Harass, stalk, threaten, or violate the rights of others.
• Transmit content that contains viruses, malware, or harmful software.
• Advertise, sell, or offer goods/services without Unibit’s consent.
• Falsify information or impersonate any person or entity.
• Restrict or inhibit other users from enjoying Opizo’s services.
• Engage in illegal activities or actions that threaten the integrity or security of India.

If a User selects a username deemed inappropriate, Unibit reserves the right to modify or delete such username without prior notice.

Unauthorized access to the Opizo Platform is a breach of these Terms & Conditions and may result in legal action. Users agree not to use automated means (bots, scripts, etc.) to access Opizo, except those explicitly approved by Unibit. Use of the Opizo Platform is subject to existing laws and regulations. Nothing in these Terms & Conditions limits Unibit’s right to comply with governmental, court, or law enforcement requests.

Users under 18 years of age are not permitted to register on Opizo. If a minor falsely declares their age, Unibit is not responsible for any consequences. The legal guardians of such a minor shall indemnify Unibit for any losses incurred due to false declarations.

Unibit is not responsible for content contributed by Users on the Opizo Platform.


Eligibility

• The Opizo Platform is open only to persons above the age of 18 years.
• The Opizo Platform is open only to persons currently residing in India.
• Persons who wish to participate must have a valid phone number.
• Opizo may, on receipt of information, bar a person from participating and/or withdrawing amounts from their Opizo Account if such person is found to have insider knowledge of certain specified future events on which such person is/has placed a bid.
• Only those participants who have successfully registered on the Opizo Platform shall be eligible to bid on the outcome of specified future events.

Payment Terms for Opizo Platform

In respect of any transactions made via the Opizo Platform, Users agree to be bound by the following payment terms:

• A User can only conduct a transaction if their Opizo Account has a minimum balance corresponding to the amount required.
• When a User initiates a transaction, Opizo shall place a hold on the transaction amount in the User’s account.
• Opizo reserves the right to charge a fee for the provision of Opizo Services (“Platform Fee”), which will be specified and notified by Opizo from time to time. The Platform Fee (inclusive of applicable tax thereon) will be debited from a User’s account balance at the time of processing the transaction. Opizo shall issue an invoice for such debits to the User.

Opizo shall provide, to all Users, sub-accounts that function as a closed system pre-paid instrument in the following manner:

Deposits Account – Users can upload real money in advance to conduct transactions and access Opizo Services. No refunds shall be provided except in cases where Opizo is unable to provide the intended services. Any refund issued as per applicable law would only cover the unutilized amount in the User’s Deposit Account and shall not include amounts already used for transactions.

Winnings Account – This account is used for storing any amounts received by a User upon successful transactions on the Platform. Users may either withdraw funds from their Winnings Account or use them for further transactions. Withdrawals are subject to limits determined by Opizo at its sole discretion.

Trading Account – Upon a User completing a successful transaction, Opizo, at its sole discretion, shall credit a percentage (which percentage shall be notified to Users from time to time) of the original transaction amount to the User’s Trading Account. Upon making a successful transaction, the total amount receivable by a User shall be bifurcated into three parts: (a) Winning Amount, (b) Traded Amount, and (c) Platform Fee. Users can withdraw amounts in the Trading Account at any time, subject to applicable limits. Withdrawals will be processed after deducting any promotional amounts credited during deposits.

Promotions Account – Opizo may, from time to time, credit additional promotional amounts as rewards for Users engaging with the Platform.

• All transaction amounts shall be debited from the User’s Opizo Account, and all credited amounts shall be subject to the deduction of the Platform Fee.
• Any unutilized funds in a User’s Deposits Account for a continuous period of 365 days from the date of deposit shall be forfeited by applicable law. Additionally, if a User does not conduct any transactions for 365 days, all funds in their Opizo Account (Deposits, Trading, Winnings, and Promotions Accounts) shall be forfeited. Opizo may, at its sole discretion, reverse such forfeiture, either in whole or in part.
• Opizo, at its sole discretion, may define limits on deposits and withdrawals. When eligible for withdrawal, Opizo shall transfer the requested amount to the User’s registered bank account within a commercially reasonable timeframe. Such transfers will be reflected as debits from the User’s Opizo Account. A processing fee may be charged for online transfers.
• Users must provide “Know Your Customer” (“KYC”) documents for withdrawals. The details in the User’s KYC documents must match those provided at the time of registration, as well as the bank records linked to the User’s account. Failure to complete KYC verification may prevent withdrawal processing.
• To support promotional activities, Opizo may issue “Promotional Balance” to Users, subject to limitations and restrictions determined solely by Opizo. The issuance of Promotional Balance is at Opizo’s discretion and cannot be claimed by Users as a matter of right.
• Subject to these Terms and Conditions and any additional Terms published by Opizo, Users agree that once they confirm a transaction on Opizo, they shall be bound by and make payment for that transaction.

Dispute and Dispute Resolution

If any dispute arising out of, or in connection with, the Opizo Services provided by Unibit via the Opizo Platform, the construction, validity, interpretation, and enforceability of these Terms & Conditions, or the rights and obligations of the User(s) or Unibit, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below arises between the User(s) and Unibit ("Dispute"), the disputing parties hereto shall endeavor to settle such Dispute amicably. The attempt to bring about an amicable settlement shall be considered to have failed if not resolved within 30 (thirty) days from the date of communicating the Dispute in writing.

If the parties are unable to amicably settle the Dispute as mentioned above, any party to the Dispute shall be entitled to serve a notice invoking Arbitration. The Dispute shall be referred to and finally resolved by arbitration. The Arbitration shall be conducted by an Arbitral Tribunal consisting of a sole arbitrator in accordance with the Rules of the Delhi International Arbitration Centre ("DIAC Rules"), which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be New Delhi. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English. The law governing the arbitration agreement shall be Indian Law.

Nothing shall preclude any Party from seeking interim or permanent equitable or injunctive relief, or both, from the competent courts at New Delhi, having jurisdiction to grant relief on any Disputes. The pursuit of equitable or injunctive relief shall not be a waiver of the duty of the Parties to pursue any remedy (including for monetary damages) through the arbitration described herein.

The arbitration award will be final and binding on the Parties.


Release and Limitations of Liability

Users shall access the Opizo Services provided via the Opizo Platform voluntarily and at their own risk. Opizo shall, under no circumstances, be held responsible or liable on account of any loss or damage sustained by Users or any other person or entity during the course of access to the Opizo Platform.

By accessing the Opizo Platform and Opizo Services provided therein, Users hereby release from and agree to indemnify Opizo, and/or any of its directors, employees, partners, associates, and licensors, from and against all liability, cost, loss, or expense arising out of their access of the Opizo Platform and the Opizo Services including (but not limited to) personal injury and damage to property, whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.

Opizo accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the data/information collated and published on the Opizo Platform.

Users shall be solely responsible for any consequences which may arise due to their access of Opizo Services by conducting an illegal act or due to non-conformity with these Terms & Conditions and other rules and regulations in relation to Opizo Services, including the provision of incorrect personal details. Users also undertake to indemnify Opizo and their respective officers, directors, employees, and agents in such an event (including without limitation cost of attorney, legal charges, etc.) on a full indemnity basis for any loss/damage suffered by Opizo on account of such act on the part of the Users.

Users shall indemnify, defend, and hold Opizo harmless from any third-party/entity/organization claims arising from or related to such User’s engagement with the Opizo Platform. In no event shall Opizo be liable to any User for acts or omissions arising out of or related to User’s engagement with the Opizo Platform.

In consideration of Opizo allowing Users to access the Opizo Platform, to the maximum extent permitted by law, the Users waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Opizo, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the provision of Opizo Services.


Disclaimers

To the extent permitted under law, neither Opizo nor its parent/holding company, subsidiaries, affiliates, directors, officers, professional advisors, or employees shall be responsible for the deletion, the failure to store, the misdelivery, or the untimely delivery of any information or material.

To the extent permitted under law, Opizo shall not be responsible for any harm resulting from downloading or accessing any information or material, the quality of servers, products, Opizo Services, or sites.

Any material accessed, downloaded, or otherwise obtained through the Opizo Platform is done at the User’s discretion, competence, acceptance, and risk, and the User will be solely responsible for any potential damage to the User’s computer system or loss of data that results from downloading any such material.

Opizo shall make its best endeavors to ensure that the platform is error-free and secure. However, neither Opizo nor any of its partners, licensors, or associates makes any warranty that:

• The Opizo Platform will meet Users’ requirements.
• The Opizo Platform will be uninterrupted, timely, secure, or error-free.
• The results that may be obtained from the use of Opizo Platform will be accurate or reliable.
• The quality of any products, Opizo Services, information, or other material that Users purchase or obtain through the Opizo Platform will meet Users’ expectations.

In case Opizo discovers any error, Opizo reserves the right (exercisable at its discretion) to rectify the error in such manner as it deems fit, including through a set-off of the erroneous payment from amounts due to the User or deduction from the User’s account of the amount of erroneous payment. In case of exercise of remedies in accordance with this clause, Opizo agrees to notify the User of the error and the remedy(ies) applied.

To the extent permitted under law, neither Opizo nor its partners, licensors, or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use our site, even if we have been advised of the possibility of such damages.

Any Opizo Services being hosted or provided, or intended to be hosted on the Opizo Platform and requiring specific permission or authority from any statutory authority or any state or the central government, or the board of directors shall be deemed canceled or terminated if such permission or authority is either not obtained or denied, either before or after the availability of the relevant Opizo Services are hosted or provided.

To the extent permitted under law, in the event of suspension or closure of any Opizo Services, Users shall not be entitled to make any demands or claims of any nature whatsoever.


Grievance Redressal Mechanism

In case a User has any complaints or grievance pertaining to (i) any Content that a User believes violates these Terms (other than an infringement of Intellectual Property Rights), (ii) Users’ access to the Opizo Platform or (iii) any Content which a User believes is, prima facie, in the nature of any material which is obscene, defamatory towards the complainant or any person on whose behalf such User is making the complaint, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual, please share the same with us by writing to: contact@unibit.in

In the complaint or grievance, the User shall include the following information:

• Name and contact details: name, address, contact number, and email address.
• Relation to the subject matter of the complaint, i.e. complainant or person acting on behalf of an affected person.
• The name and age of the person aggrieved or affected by the subject matter of the complaint, in case the User is acting on behalf of such person and a statement that the User is authorized to act on behalf of such person and to provide such person’s personal information to Opizo in relation to the complaint/grievance.
• Description of the complaint or grievance with clear identification of the Content in relation to which such complaint or grievance is made.
• A statement that the User believes, in good faith, that the Content violates these Terms and Conditions.
• A statement that the information provided in the complaint or grievance is accurate.

Opizo respects the Intellectual Property Rights of others. All names, logos, marks, labels, trademarks, copyrights, or intellectual and proprietary rights on the Opizo Platform belonging to any person (including User), entity, or third party are recognized as proprietary to the respective owners. Users are requested to send Opizo a written notice/intimation if Users notice any act of infringement on the Opizo Platform, which must include the following information:

• A clear identification of the copyrighted work allegedly infringed.
• A clear identification of the allegedly infringing material on the Opizo Platform.
• Contact details: name, address, email address, and phone number.
• A statement that the User believes, in good faith, that the use of the copyrighted material allegedly infringed on the Opizo Platform is not authorized by the User’s agent or the law.
• A statement that the information provided in the notice is accurate and that the signatory is authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed.
• User’s signature or a signature of the User’s authorized agent.

On receiving such a complaint, grievance, or notice, Opizo reserves the right to investigate and/or take such action as Opizo may deem appropriate. Opizo may reach out to the User to seek further clarification or assistance with the investigation or verify the statements made in the complaint, grievance, or notice, and the User acknowledges that timely assistance with the investigation would facilitate the redressal of the same.

The Grievance Officer identified above is appointed pursuant to the provisions of applicable laws, including but not limited to the Information Technology Act, 2000, and the Consumer Protection Act, 2019, along with the Rules enacted under those laws. The Company reserves the right to replace the Grievance Redressal Officer at its discretion through publication of the name and title of such replacement on the website, which replacement shall come into effect immediately upon publication.
